Allen v. State, DHSS, Div. of Public Assistance / Wallis v. State, DHSSThese consolidated cases address what federal food stamp laws require of the State of Alaska when it makes a mistake with federal dollars. Appellants argue that the state doctrine of equitable estoppel prevents the State from requiring Appellants and other food stamp recipients to repay agency-caused overpayments. The State disagrees and argues that the applicable federal food stamp laws pre-empt Appellants from making an equitable estoppel defense.
