MacDonald v. Wilson and RiggsFollowing an assault, McDonald brought an action against Wilson and Riggs. Riggs filed a counterclaim for defamation. After the presentation of evidence, MacDonald moved for a directed verdict against Riggs on his defamation claim, which the court denied. The jury awarded MacDonald $210,000 against Wilson and found Riggs not liable, but awarded him $35,000 on his defamation counterclaim. MacDonald moved for judgment not withstanding the verdict, which the court denied. MacDonald appeals the defamation verdict, claiming Riggs failed to present sufficient evidence and any potentially defamatory statements were time barred.
