Legal commentator John Gaguine discusses two recent decisions that provide recourse for those inundated with junk faxes. A three judge appellate court panel in New York overturned decisions in lower courts that had dismissed actions seeking damages for sending junk faxes. A separate decision in Georgia makes it easier for recipients of junk faxes to form a class and sue the offending business for damages. An Atlanta car wash faces $110 million in penalties as a result of sending out 73,500 faxes.
