Bragg v. Matanuska-Susitna Borough The Matanuska-Susitna Borough levies an excise tax on wholesalers and distributers of cigarettes and other tobacco products. Bragg and Fannon challenge the trial court’s ruling that the excise tax was not a tax which was limited by other state laws. Although agreeing with the basic trial court ruling, the Borough cross-appeals because Bragg and Fannon are not responsible for paying the tax and should not be allowed to sue the Borough on this issue.

Kim v. Alyeska Seafoods, Inc. Kim, a Washington resident, claims he was injured while working for Alyeska Seafoods in 2002. Alaska statues and regulations require that an injured worker request a hearing within two years of filing the claim and after the employer has answered and denied the claim. Kim's attorney filed a request to continue the case but did not request a hearing. Kim appeals the dismissal of his claim and argues that he complied with the statute and is entitled to a hearing.

Bohlmann v. Alaska Construction & Engineering, Inc. Following a work injury for which he received time loss benefits, appellant Bohlmann sought an adjustment of his compensation rate. The employer denied the request which triggered a two-year time limit for requesting a hearing. Bohlmann's request for a compensation rate adjustment was denied and dismissed due to his failure to request a hearing within two years. Bohlman argues his failure to timely request a hearing should be excused primarily due to his status as a pro se litigant.
