Krause v. Matanuska-Susitna Borough The Matanuska-Susitna Borough received a subdivision plat from Christiansen and recorded it. Krause challenged the action and sued, but the case was dismissed in part because the complaint did not allege a proper claim and, in part, because the statute of limitations had run. Krause asked to re-file the complaint arguing the statue of limitations was extended under "equitable tolling" - a principle where the plaintiff, despite use of due diligence, could not or did not discover the injury until after the expiration of the limitations period.

Schiel v. Union Oil Company of California Joseph Schiel, an employee of Peak Oilfield Services Company, was injured on an oil platform owned by Union Oil Company of California (UNOCAL). He filed suit against UNOCAL in state court. UNOCAL removed to federal court and sought summary judgment barring Schiel's claims under the 2004 Amendments to the Workers Compensation Statutes. Alaska statutes exempt contractors and project owners from tort liability for injury to an employee of a subcontractor. Schiel argues that the Amendments violate his equal protection and due process rights.
