Mark J. Avery again charged with bilking woman
A former Anchorage man has again been indicted by a federal grand jury of bilking a woman out of $52 million dollars.
Federal prosecutor Steve Skrocki say 54-year-old Mark J. Avery of San Francisco on Thursday pleaded not guilty to five counts of wire fraud and 10 counts of money laundering.
It’s the second time around for Avery.
In 2007, Avery pleaded guilty to stealing from May Wong Smith and May Smith Trust.
A 2010 decision by the U.S. Supreme Court narrowed the definition of the kind of wire fraud to which Avery pleaded guilty. A three-judge panel of the 9th U.S. Circuit Court of Appeals in June said the type of “crime” Avery admitted is no longer a crime.
His federal public defender declined comment on Thursday.
